  Parties having need of three thousand two hundred and eleven feet of best quality zinc-plated spiral-twist lightning-rod stuff, and sixteen hundred and thirty-one silver-tipped points, all in tolerable repair (and, although much worn by use, still equal to any ordinary emergency), can hear of a bargain by addressing the publisher.

  SCIENCE VS. LUCK

  AT THAT time, in Kentucky (said the Hon. Mr. K——), the law was very strict against what is termed “games of chance.” About a dozen of the boys were detected playing “seven-up” or “old sledge” for money, and the grand jury found a true bill against them. Jim Sturgis was retained to defend them when the case came up, of course. The more he studied over the matter, and looked into the evidence, the plainer it was that he must lose a case at last—there was no getting around that painful fact. Those boys had certainly been betting money on a game of chance. Even public sympathy was roused in behalf of Sturgis. People said it was a pity to see him mar his successful career with a big prominent case like this, which must go against him.

  But after several restless nights an inspired idea flashed upon Sturgis, and he sprang out of bed delighted. He thought he saw his way through. The next day he whispered around a little among his clients and a few friends, and then when the case came up in court he acknowledged the seven-up and the betting, and, as his sole defense, had the astounding effrontery to put in the plea that old sledge was not a game of chance! There was the broadest sort of a smile all over the faces of that sophisticated audience. The judge smiled with the rest. But Sturgis maintained a countenance whose earnestness was even severe. The opposite counsel tried to ridicule him out of his position, and did not succeed. The judge jested in a ponderous judicial way about the thing, but did not move him. The matter was becoming grave. The judge lost a little of his patience, and said the joke had gone far enough. Jim Sturgis said he knew of no joke in the matter—his clients could not be punished for indulging in what some people chose to consider a game of chance until it was proven that it was a game of chance. Judge and counsel said that would be an easy matter, and forthwith called Deacons Job, Peters, Burke, and Johnson, and Dominies Wirt and Miggles, to testify; and they unanimously and with strong feeling put down the legal quibble of Sturgis by pronouncing that old sledge was a game of chance.

  “What do you call it now?” said the judge.

  “I call it a game of science!” retorted Sturgis; “and I’ll prove it, too!”

  They saw his little game.

  He brought in a cloud of witnesses, and produced an overwhelming mass of testimony, to show that old sledge was not a game of chance but a game of science.

  Instead of being the simplest case in the world, it had somehow turned out to be an excessively knotty one. The judge scratched his head over it awhile, and said there was no way of coming to a determination, because just as many men could be brought into court who would testify on one side as could be found to testify on the other. But he said he was willing to do the fair thing by all parties, and would act upon any suggestion Mr. Sturgis would make for the solution of the difficulty.

  Mr. Sturgis was on his feet in a second.

  “Impanel a jury of six of each, Luck versus Science. Give them candles and a couple of decks of cards. Send them into the jury-room, and just abide by the result!”

  There was no disputing the fairness of the proposition. The four deacons and the two dominies were sworn in as the “chance” jurymen, and six inveterate old seven-up professors were chosen to represent the “science” side of the issue. They retired to the jury-room.

  In about two hours Deacon Peters sent into court to borrow three dollars from a friend. [Sensation.] In about two hours more Dominie Miggles sent into court to borrow a “stake” from a friend. [Sensation.] During the next three or four hours the other dominie and the other deacons sent into court for small loans. And still the packed audience waited, for it was a prodigious occasion in Bull’s Corners, and one in which every father of a family was necessarily interested.

  The rest of the story can be told briefly. About daylight the jury came in, and Deacon Job, the foreman, read the following

  VERDICT

  We, the jury in the case of the Commonwealth of Kentucky vs. John Wheeler et al., have carefully considered the points of the case, and tested the merits of the several theories advanced, and do hereby unanimously decide that the game commonly known as old sledge or seven-up is eminently a game of science and not of chance. In demonstration whereof it is hereby and herein stated, iterated, reiterated, set forth, and made manifest that, during the entire night, the “chance” men never won a game or turned a jack, although both feats were common and frequent to the opposition; and furthermore, in support of this our verdict, we call attention to the significant fact that the “chance” men are all busted, and the “science” men have got the money. It is the deliberate opinion of this jury, that the “chance” theory concerning seven-up is a pernicious doctrine, and calculated to inflict untold suffering and pecuniary loss upon any community that takes stock in it.

  “That is the way that seven-up came to be set apart and particularized in the statute-books of Kentucky as being a game not of chance but of science, and therefore not punishable under the law,” said Mr. K——. “That verdict is of record, and holds good to this day.”

  THE STORY OF THE GOOD LITTLE BOY

  ONCE THERE was a good little boy by the name of Jacob Blivens. He always obeyed his parents, no matter how absurd and unreasonable their demands were; and he always learned his book, and never was late at Sabbath-school. He would not play hookey, even when his sober judgment told him it was the most profitable thing he could do. None of the other boys could ever make that boy out, he acted so strangely. He wouldn’t lie, no matter how convenient it was. He just said it was wrong to lie, and that was sufficient for him. And he was so honest that he was simply ridiculous. The curious ways that Jacob had, surpassed everything. He wouldn’t play marbles on Sunday, he wouldn’t rob birds’ nests, he wouldn’t give hot pennies to organ-grinders’ monkeys; he didn’t seem to take any interest in any kind of rational amusement. So the other boys used to try to reason it out and come to an understanding of him, but they couldn’t arrive at any satisfactory conclusion. As I said before, they could only figure out a sort of vague idea that he was “afflicted,” and so they took him under their protection, and never allowed any harm to come to him.

  This good little boy read all the Sunday-school books; they were his greatest delight. This was the whole secret of it. He believed in the good little boys they put in the Sunday-school books; he had every confidence in them. He longed to come across one of them alive once; but he never did. They all died before his time, maybe. Whenever he read about a particularly good one he turned over quickly to the end to see what became of him, because he wanted to travel thousands of miles and gaze on him; but it wasn’t any use; that good little boy always died in the last chapter, and there was a picture of the funeral, with all his relations and the Sunday-school children standing around the grave in pantaloons that were too short, and bonnets that were too large, and everybody crying into handkerchiefs that had as much as a yard and a half of stuff in them. He was always headed off in this way. He never could see one of those good little boys on account of his always dying in the last chapter.

  Jacob had a noble ambition to be put in a Sunday-school book. He wanted to be put in, with pictures representing him gloriously declining to lie to his mother, and her weeping for joy about it; and pictures representing him standing on the doorstep giving a penny to a poor beggar-woman with six children, and telling her to spend it freely, but not to be extravagant, because extravagance is a sin; and pictures of him magnanimously refusing to tell on the bad boy who always lay in wait for him around the corner as he came from school, and welted him over the head with a lath, and then chased him home, saying, “Hi! hi!” as he
proceeded. That was the ambition of young Jacob Blivens. He wished to be put in a Sunday-school book. It made him feel a little uncomfortable sometimes when he reflected that the good little boys always died. He loved to live, you know, and this was the most unpleasant feature about being a Sunday-school-book boy. He knew it was not healthy to be good. He knew it was more fatal than consumption to be so supernaturally good as the boys in the books were; he knew that none of them had ever been able to stand it long, and it pained him to think that if they put him in a book he wouldn’t ever see it, or even if they did get the book out before he died it wouldn’t be popular without any picture of his funeral in the back part of it. It couldn’t be much of a Sunday-school book that couldn’t tell about the advice he gave to the community when he was dying. So at last, of course, he had to make up his mind to do the best he could under the circumstances—to live right, and hang on as long as he could, and have his dying speech all ready when his time came.

  But somehow nothing ever went right with this good little boy; nothing ever turned out with him the way it turned out with the good little boys in the books. They always had a good time, and the bad boys had the broken legs; but in his case there was a screw loose somewhere, and it all happened just the other way. When he found Jim Blake stealing apples, and went under the tree to read to him about the bad little boy who fell out of a neighbor’s apple tree and broke his arm, Jim fell out of the tree, too, but he fell on him and broke his arm, and Jim wasn’t hurt at all. Jacob couldn’t understand that. There wasn’t anything in the books like it.

  And once, when some bad boys pushed a blind man over in the mud, and Jacob ran to help him up and receive his blessing, the blind man did not give him any blessing at all, but whacked him over the head with his stick and said he would like to catch him shoving him again, and then pretending to help him up. This was not in accordance with any of the books. Jacob looked them all over to see.

  One thing that Jacob wanted to do was to find a lame dog that hadn’t any place to stay, and was hungry and persecuted, and bring him home and pet him and have that dog’s imperishable gratitude. And at last he found one and was happy; and he brought him home and fed him, but when he was going to pet him the dog flew at him and tore all the clothes off him except those that were in front, and made a spectacle of him that was astonishing. He examined authorities, but he could not understand the matter. It was of the same breed of dogs that was in the books, but it acted very differently. Whatever this boy did he got into trouble. The very things the boys in the books got rewarded for turned out to be about the most unprofitable things he could invest in.

  Once, when he was on his way to Sunday-school, he saw some bad boys starting off pleasuring in a sailboat. He was filled with consternation, because he knew from his reading that boys who went sailing on Sunday invariably got drowned. So he ran out on a raft to warn them, but a log turned with him and slid him into the river. A man got him out pretty soon, and the doctor pumped the water out of him, and gave him a fresh start with his bellows, but he caught cold and lay sick abed nine weeks. But the most unaccountable thing about it was that the bad boys in the boat had a good time all day, and then reached home alive and well in the most surprising manner. Jacob Blivens said there was nothing like these things in the books. He was perfectly dumfounded.

  When he got well he was a little discouraged, but he resolved to keep on trying anyhow. He knew that so far his experiences wouldn’t do to go in a book, but he hadn’t yet reached the allotted term of life for good little boys, and he hoped to be able to make a record yet if he could hold on till his time was fully up. If everything else failed he had his dying speech to fall back on.

  He examined his authorities, and found that it was now time for him to go to sea as a cabin-boy. He called on a ship-captain and made his application, and when the captain asked for his recommendations he proudly drew out a tract and pointed to the word, “To Jacob Blivens, from his affectionate teacher.” But the captain was a coarse, vulgar man, and he said, “Oh, that be blowed! that wasn’t any proof that he knew how to wash dishes or handle a slush-bucket, and he guessed he didn’t want him.” This was altogether the most extraordinary thing that ever happened to Jacob in all his life. A compliment from a teacher, on a tract, had never failed to move the tenderest emotions of ship-captains, and open the way to all offices of honor and profit in their gift—it never had in any book that ever he had read. He could hardly believe his senses.

  This boy always had a hard time of it. Nothing ever came out according to the authorities with him. At last, one day, when he was around hunting up bad little boys to admonish, he found a lot of them in the old iron-foundry fixing up a little joke on fourteen or fifteen dogs, which they had tied together in long procession, and were going to ornament with empty nitroglycerin cans made fast to their tails. Jacob’s heart was touched. He sat down on one of those cans (for he never minded grease when duty was before him), and he took hold of the foremost dog by the collar, and turned his reproving eye upon wicked Tom Jones. But just at that moment Alderman McWelter, full of wrath, stepped in. All the bad boys ran away, but Jacob Blivens rose in conscious innocence and began one of those stately little Sunday-school-book speeches which always commence with “Oh, sir!” in dead opposition to the fact that no boy, good or bad, ever starts a remark with “Oh, sir.” But the alderman never waited to hear the rest. He took Jacob Blivens by the ear and turned him around, and hit him a whack in the rear with the flat of his hand; and in an instant that good little boy shot out through the roof and soared away toward the sun, with the fragments of those fifteen dogs stringing after him like the tail of a kite. And there wasn’t a sign of that alderman or that old iron-foundry left on the face of the earth; and, as for young Jacob Blivens, he never got a chance to make his last dying speech after all his trouble fixing it up, unless he made it to the birds; because, although the bulk of him came down all right in a tree-top in an adjoining county, the rest of him was apportioned around among four townships, and so they had to hold five inquests on him to find out whether he was dead or not, and how it occurred. You never saw a boy scattered so. 1

  Thus perished the good little boy who did the best he could, but didn’t come out according to the books. Every boy who ever did as he did prospered except him. His case is truly remarkable. It will probably never be accounted for.

  BUCK FANSHAW’S FUNERAL

  SOMEBODY HAS said that in order to know a community, one must observe the style of its funerals and know what manner of men they bury with most ceremony. I cannot say which class we buried with most éclat in our “flush times,” the distinguished public benefactor or the distinguished rough—possibly the two chief grades or grand divisions of society honored their illustrious dead about equally; and hence, no doubt, the philosopher I have quoted from would have needed to see two representative funerals in Virginia before forming his estimate of the people.

  There was a grand time over Buck Fanshaw when he died. He was a representative citizen. He had “killed his man”—not in his own quarrel, it is true, but in defense of a stranger unfairly beset by numbers. He had kept a sumptuous saloon. He had been the proprietor of a dashing helpmeet whom he could have discarded without the formality of a divorce. He had held a high position in the fire department and been a very Warwick in politics. When he died there was great lamentation throughout the town, but especially in the vast bottom-stratum of society.

  On the inquest it was shown that Buck Fanshaw, in the delirium of a wasting typhoid fever, had taken arsenic, shot himself through the body, cut his throat, and jumped out of a four-story window and broken his neck—and after due deliberation, the jury, sad and tearful, but with intelligence unblinded by its sorrow, brought in a verdict of death “by the visitation of God.” What could the world do without juries?

  Prodigious preparations were made for the funeral. All the vehicles in town were hired, all the saloons put in mourning, all the municipal
and fire-company flags hung at half-mast, and all the firemen ordered to muster in uniform and bring their machines duly draped in black. Now—let us remark in parentheses—as all the peoples of the earth had representative adventures in the Silverland, and as each adventurer had brought the slang of his nation or his locality with him, the combination made the slang of Nevada the richest and the most infinitely varied and copious that had ever existed anywhere in the world, perhaps, except in the mines of California in the “early days.” Slang was the language of Nevada. It was hard to preach a sermon without it, and be understood. Such phrases as “You bet!” “Oh, no, I reckon not!” “No Irish need apply,” and a hundred others, became so common as to fall from the lips of a speaker unconsciously—and very often when they did not touch the subject under discussion and consequently failed to mean anything.

  After Buck Fanshaw’s inquest, a meeting of the short-haired brotherhood was held, for nothing can be done on the Pacific coast without a public meeting and an expression of sentiment. Regretful resolutions were passed and various committees appointed; among others, a committee of one was deputed to call on the minister, a fragile, gentle, spiritual new fledgling from an Eastern theological seminary, and as yet unacquainted with the ways of the mines. The committeeman, “Scotty” Briggs, made his visit; and in after days it was worth something to hear the minister tell about it. Scotty was a stalwart rough, whose customary suit, when on weighty official business, like committee work, was a fire-helmet, flaming red flannel shirt, patent-leather belt with spanner and revolver attached, coat hung over arm, and pants stuffed into boot-tops. He formed something of a contrast to the pale theological student. It is fair to say of Scotty, however, in passing, that he had a warm heart, and a strong love for his friends, and never entered into a quarrel when he could reasonably keep out of it. Indeed, it was commonly said that whenever one of Scotty’s fights was investigated, it always turned out that it had originally been no affair of his, but that out of native good-heartedness he had dropped in of his own accord to help the man who was getting the worst of it. He and Buck Fanshaw were bosom friends, for years, and had often taken adventurous “pot-luck” together. On one occasion, they had thrown off their coats and taken the weaker side in a fight among strangers, and after gaining a hard-earned victory, turned and found that the men they were helping had deserted early, and not only that, but had stolen their coats and made off with them. But to return to Scotty’s visit to the minister. He was on a sorrowful mission, now, and his face was the picture of woe. Being admitted to the presence he sat down before the clergyman, placed his fire-hat on an unfinished manuscript sermon under the minister’s nose, took from it a red silk handkerchief, wiped his brow and heaved a sigh of dismal impressiveness, explanatory of his business. He choked, and even shed tears; but with an effort he mastered his voice and said in lugubrious tones:
